Surgical Injury Case Profile
Thirty-seven year
old woman admitted to the hospital for elective laparoscopic gall bladder
surgery. During the procedure extensive bleeding occurred. The procedure
was converted to an open surgery with attempts to cut and clip the bleeders.
Finally, the bleeding was under control. The surgeons closed the patient
with plans to do a follow up test to determine where the clips had been
placed and what structures had been cut or clipped. This was never done.
The patient was watched in the hospital for another four weeks while
her condition deteriorated. Finally, the patient was transferred and
the originally planned test was finally done showing severe injury to
the common bile duct and the blood supply to the liver. The patient
was sent to Boston where she had to be conservatively managed with drains
and therapy for the next month. She was then readmitted for an extensive
liver reconstructive surgery. The findings were that half of her liver
had become liquefied because of the lack of adequate blood supply. After
the surgery, the patient recovered and after two years is back to work
and living a normal life.
RESULT: Settlement - 1.15 million dollars.
Emergency Room Injury Case Profile
Forty-eight year old man backed a lawn tractor off a flatbed. The ramp gave way and the tractor landed on top of him breaking his back. Emergency medical technicians came to the scene, tested him and found that he had sensation and strength in his legs. He was taken to an emergency room where a physician's assistant took over his care. Because of a large grapefruit-sized bump on his lower back, he had been strapped to the longboard face down. For some reason the PA ordered him flipped over so that he could get a CT scan. As he was flipped, the patient cried out, "I can't feel from the waist down". He has been paralyzed ever since.
The claim was that there was no need to flip him over to his back and that
this was a contributing factor to his paralysis.
