Fifteen-year-old boy from central Maine traveled to an outdoor rock and roll festival in Rhode Island. During one of the performances, he engaged in an activity called "moshing" and "crowd surfing". This is where crowd members lift individuals up and pass them hand to hand overhead. During this activity, he was dropped on his head causing permanent C4-5 quadriplegia. A claim was brought against the promoter, the organizer and the site claiming it was negligent to allow this activity to take place, there was inadequate public event security, and severe injury was foreseeable. The defense argued that the young man voluntarily engaged in the activity knowing it was dangerous and that there was no way to prevent the activity from taking place.
Result: Settlement - 2.9 million dollars
